If people at my job are getting sick at work due to mold is there something we can do . Our Boss don't care.?
I work for Wal-Mart in Yuba City CA. I have gone through proper channels to complain about the mold smell that is in almost all the clothing areas. My store manager is only interested in meetings and filling the shelves. I have been moved from apparel to another part of the store. The other girls are still there. Scared they will lose their jobs if they complain. Meanwhile they tell me of sinus headaches and ear infections and other problems.
Strange to say, but something has to happen before you will be able to file a Personal Injury claim. Therefore, you must get sick or injured, go to the hospital (get a medical diagnosis, such as mold poisoning), and then you may file a claim. That means, if the girls or yourself are having trouble with mildew at work, you should start going to the hospital to begin building your case.
There are mainly two laws that may help you. The first is personal injury and the second is personal property. The personal property law requires that the injury be "foreseeable." This means that if someone trips on your property, on a brick sticking up on the sidewalk for example, you may be protected from being sued. However, if you know that there is a brick there and have been warned about the brick, then you may be liable for damages if someone falls and hurt themselves. Therefore, while the supervisor is ignoring your requests, be sure to document the issue. Preferably, in writing.
You may make a formal letter to management; delivered by certified mail. Give management 3-5 days to respond, for example, in writing. If they do not return your letter in the time allotted, warn them that you will proceed with further action. After this date, you or your co-workers should begin going to the hospital once you become sick. Your company may be liable to pay the bills that accumulate as a result. You should try your best to get this problem solved in a courteous manner. However, there is still no guarantee your manager will not try to retaliate on you.
OSHA has laws that protect workers from being terminated because of protecting themselves from on the job injuries. It is called the OSHA WHISTLEBLOWER PROTECTION. For instance, if you are told by your manager to tear down a shelf and you go get a pair of safety glasses. You may even get away with refusing to go into the room where the mildew is present, even if you have been given an assignment. However, I have known many supervisors successfully terminate an employee, anyways. It is always for something far from the real issue. They may suddenly begin picking on you. For instance, they may tell you to mop the floor and when you are done, they will complain to you about taking too much time. They may even pile excessive work on you and when you are not able to complete the assignments, they will terminate you for not performing job duties up to standard.
So, be aware of this. Don't sell your soul to the devil. If you believe in your cause you should fight for it no matter what the consequences. What if Rosie Parks had've back-down from giving up her seat? Many individuals may still be forced to sit at the back of the bus. Be sure to document everything and do things by going through the proper channels. You have tried to do things on a personal level and have failed and now, you need to try something different.
Poisoning from toxic mold is a serious health issue. However, not all mold is toxic. The mold has to be properly tested to determine if it is toxic or not. Keep this in mind. The smell of moisture may just be gross, but non-toxic. So, you may have your supervisor have the mold tested, first. Because sometimes, the human mind can play tricks on you.
